Resilient Hearts Adult Day Center – Terms of Service

  1. Agreement to Terms

By submitting a payment to Resilient Hearts Adult Day Center (the “Center”), you agree to be bound by these Terms of Service. These terms govern your payment of the enrollment fee and provide authorization for future charges for services rendered.

  1. Enrollment Fee

The non-refundable enrollment fee is required to secure your loved one’s place in the Resilient Hearts Adult Day Center program. The submission of this payment confirms your understanding and agreement that this fee is non-refundable under any and all circumstances, including but not limited to, program cancellation, change in personal circumstances, or withdrawal from the program.

  1. Automatic Billing Authorization

By providing your payment information for the enrollment fee, you are also providing an explicit, ongoing authorization for Resilient Hearts Adult Day Center to securely store this payment method on file and to automatically charge it for all future services provided by the Center.

You hereby authorize the Center to charge the payment method on file for any and all recurring fees, including but not limited to, daily service fees, monthly fees, transportation costs, and any additional services agreed upon. These charges will be processed automatically as they become due.

  1. Data Security and PCI Compliance

Resilient Hearts Adult Day Center uses a secure third-party payment processor, Stripe, to handle all payment transactions. Your sensitive payment information is securely transmitted directly to Stripe and is not stored on our servers. This practice is in place to ensure compliance with the Payment Card Industry Data Security Standard (PCI DSS), protecting your financial information.

  1. Notifications and Failed Payments

You agree to keep your payment information current and up-to-date. In the event that an automatic charge fails, Resilient Hearts Adult Day Center will notify you via the email address on file. You are responsible for promptly updating your payment information or providing an alternative form of payment to cover the outstanding balance. Failure to address a failed payment within a reasonable timeframe may result in a suspension of services.

  1. Changes to Terms

Resilient Hearts Adult Day Center reserves the right to update or modify these Terms of Service at any time. We will provide notice of any material changes via email or an announcement on our website. Your continued use of our services after such modifications constitutes your acceptance of the new terms.

  1. Dispute Resolution

Any disputes regarding these terms or your account with Resilient Hearts Adult Day Center should be brought to our attention in writing. We will make every reasonable effort to resolve the issue amicably.

  1. Disclaimer of Liability

Resilient Hearts Adult Day Center, its employees, and its agents are not responsible for any issues arising from failed payments, fraudulent charges on your account by third parties, or any other unauthorized use of your payment method that is not a direct result of our negligence.

By proceeding with payment, you acknowledge that you have read, understood, and agree to these terms in their entirety.
